Affidavit of Paternity
This document is a voluntary statement by both the mother and father (or either alone) that the father is the biological father of a child in or from the womb of the mother. It is drafted to satisfy the requirements of the Texas Family Code and is a one tool used to determine the parentage of the child before or after birth. Also, the mother and father separately can indicate whether or not they want to be personally notified of any lawsuits or court proceedings relating to the child.
Premarital Agreement
People who marry in Texas enter into a partnership. State statutes govern the operation of the partnership unless a written contract, called a pre-marital or antenupital agreement is
made between the parties who intend to marry. This agreement can adjust property and income rights, provide for children by either party by a prior relationship, govern responsibility for child care or household tasks, provide for insurance, and division of property on death or divorce. Pre-marital agreements are increasingly popular with older persons who have substantial property and adult children. Use by women with careers and established credit is also growing.
Cohabitation Agreements
A nonmarital cohabitation or “living together” agreement is useful for people who intend to share the same household as unmarried partners. The relationships between the parties can range from (1)highly committed, much like a marriage, (2) simply roommates who desire to split rent, utilities and household tasks, to (3) parents of adults who live at home. The situations in which a cohabitation agreement is useful are various and the agreement should be tailored for each particular situation. After a nonmarital cohabitation agreement is created, it is very important for the parties to comply with its terms in order to make it enforceable and binding. Parties with cohabitation agreements often report that conflict and dispute is reduced because they each know what is and what is not expected of them. Then, if the relationship ends, and the parties no longer see eye to eye, the parties have prepared in advance a course of action which fairly and objectively allows the parties to go their separate ways.
Cohabitation Termination Agreement
This document terminates the rights and divides the responsibilities of parties who have been sharing a residence with or without a written cohabitation agreement and now desire to go their separate ways. Provisions for temporary support, division of jointly acquired property and assumption of jointly acquired debts are common termination provisions.
